Effective Date: October 19, 2026
These Terms of Service ("Terms") govern your use of the Scannibal mobile application and website ("the App"), developed by Kiran Rao ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. Please read the Dispute Resolution section: it requires most disputes to be resolved through individual arbitration and waives class actions, unless you opt out.
Scannibal uses artificial intelligence to analyze photos of food, menus, product labels, barcodes, plants, and other items across its scan modes, answers questions in Ask Scannibal, and translates text. It provides information about allergens, diets, nutrition, pet safety, skincare ingredients, supplement interactions, grocery labels, produce quality, and growing guides.
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.
AI can be wrong. Results are informational only. They are not medical, dietary, nutritional, veterinary, or legal advice, and they are not a guarantee that anything is safe. Always read labels, confirm ingredients and allergens with restaurant staff or the manufacturer, and consult your doctor, pharmacist, dietitian, or vet before making health decisions.
Specifically:
Scannibal is not an emergency service. If you or someone else is having an allergic reaction or a medical emergency, call 911 or your local emergency number immediately. For a possible poisoning in the US, call Poison Control at 1-800-222-1222. For a pet, call your vet or the ASPCA Animal Poison Control Center at (888) 426-4435 (a fee may apply).
You decide what to eat, buy, give your pet, or take. You assume all risk of relying on results from the App. The quality of results depends on the photo, the information visible in it, and the profiles you enter.
Scannibal is free to download. An optional Pro subscription may be offered. If it is, purchases are handled and billed by Apple (App Store) or Google (Google Play) and are subject to their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies. Prices and features will be shown before you buy.
Scannibal is developed by the same people who run the Dia Fund, a small fund that gives to charities for hunger, kids, animals, and the planet. This relationship is a voluntary association, not a revenue-sharing arrangement, and does not create a legal obligation to any user or third party. This section will be updated if that relationship changes.
When you share a result, allergy card or staff phrase, the shared text is placed at a public, unlisted link that anyone with the link can open, and it is deleted after 90 days. You are responsible for what you choose to share. Do not share other people's information without their permission.
You agree not to misuse the App, including attempting to circumvent rate limits, reverse-engineer the App, use automated tools to access the service, upload unlawful or infringing content, or use the App for any unlawful purpose. We may limit or suspend access to protect the service.
The Scannibal name, design, and content are the intellectual property of Kiran Rao. You may share scan results generated by the App for personal, non-commercial purposes.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or complete.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any harm resulting from reliance on AI-generated results, including allergic reactions, pet injuries or illness, skin reactions, adverse supplement or medication interactions, or foodborne illness. To the maximum extent permitted by law, our total liability for any claim relating to the App is limited to the greater of US$50 or the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
To the extent permitted by law, you agree to indemnify and hold us harmless from claims by third parties arising from your misuse of the App or your violation of these Terms.
Informal resolution first. Before filing a claim, you agree to email us at the address below with a description of the dispute, and to try to resolve it informally for at least 30 days.
Arbitration or small claims. If it is not resolved, either of us may bring an individual claim in small-claims court, or the dispute will be resolved by individual, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be held by video or in the county where you live.
Class action waiver. You and we agree that claims may be brought only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative action.
Opt out. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms, saying that you opt out. Opting out will not affect any other part of these Terms.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Any claim not subject to arbitration will be brought in the state or federal courts located in California.
If you downloaded the App from the Apple App Store, the terms of Apple's standard Licensed Application End User License Agreement also apply. These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the App (including product liability, legal or regulatory compliance, or intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. If you downloaded the App from Google Play, Google Play's terms also apply, and Google is likewise not responsible for the App.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. If the class action waiver is found unenforceable for a claim, that claim will not be arbitrated and will proceed in court.
